ARTICLE V. The Student Senate Hearing Board

Section 1

A. The Student Senate Hearing Board shall consist of seven members.

1. The Chief Justice of the Student Senate Hearing Board

a. shall establish hearing times, preside at the sessions of the Board, and communicate the Board's recommendations to the Dean of Students or designated representative.

b. shall assist the Dean of Students or designated representative in forming and training members of lower hearing boards.

c. shall, in cooperation with the Student Senate President, make recommendations to the Student Senate for the replacements of Student Senate Hearing Board vacancies.

2. The associate Chief Justice of the Student Senate Hearing Board

a. shall preside over the Board in the absence of the Chief Justice.

b. shall assume the office of Chief Justice should it become vacant.

3. Five Associate Justices of the Student Hearing Board.

4. The Judicial Appointments Committee shall select four alternatives in addition to the seven permanent justices.

B. The Dean of Students or designated representative shall serve as advisor to the Student Senate Hearing Board.

Section 2. Selection Process

A. The Judicial Appointments Committee

1. Composition

a. The Dean of Students or designated representative, chairperson

b. The current Chief Justice of the Student Hearing Board

c. One faculty member, to be appointed by the Student Senate

d. Two students, to be appointed by the Student Senate

2. The Committee shall be formed during the spring term of each year to interview candidates for the Student Senate Hearing Board.

3. The Committee's recommendations are to be sent to the Student Senate by 11th week of spring term for ratification.

B. Qualifications for the Student Senate Hearing Board

1. Each member shall have attained a cumulative grade point average of at least 2.3 on a four-point scale by the time of nomination and shall maintain such throughout their term of office.

2. Prerequisite to consideration for office shall be possessing a knowledge of, and support of the basic tenets of Anglo-Saxon jurisprudence.

3. The Student Senate Hearing Board shall reflect the composition of the student body.

4. No member of the Student Senate Hearing Board may hold office in Student Senate or be a Resident Advisor.

Section 3. Inauguration and Term of Office

A. The Student Senate Hearing Board members shall officially take office upon their affirmation of the following credo, presented to them by the President of the Student Senate prior to their first hearing in the fall:

"I, [state your name], as a member of the Wittenberg University Student Hearing Board, do swear and affirm to uphold the Constitution of the United States of America, the Constitution of the State of Ohio, and the Constitution of the Wittenberg University Student Government, on addition to the rules and regulations of Wittenberg University and shall uphold the provisions thereof, and do faithfully promise to uphold the rights and privileges of all members of the Wittenberg University Community."

B. The Student Senate Hearing Board term of office ends at the close of the Board's last hearing of spring term.

Section 4. Vacancies: With recommendations of the Student Senate President and the Student Hearing Board Chief Justice, shall be promptly filled by the Student Senate.

Section 5. Judicial Powers

A. The Student Senate Hearing Board shall have the power, at the request of the involved student(s), to investigate cases regarding student disciplinary violations.

B. The Student Senate Hearing Board shall have original jurisdiction in cases of judicial review of student legislation.

C. The Student Senate Hearing Board shall have original jurisdiction over non-greek organizations.

Section 6. Judicial Procedures

A. No cases may be heard without the presence of a quorum, consisting of five justices.

B. All decisions of the Student Senate Hearing Board must consist of a majority vote.

C. All disciplinary decisions are recommendations for the Dean of Students or designated representative concerning the disposition of such cases:

1. The Student Senate Hearing Board shall render a recommendation within five days of the hearing's completion.

2. The Dean of Students or designated representative shall determine the final disposition of all cases.

3. If the final disposition is challenged by the student(s) charged, an appeal may be made to the Student Appellate Board.

a. The Student Appellate Board consists of four faculty and four students.

b. At the request of the student(s) charged, the student members of the
Student Appellate Board will be excused from participating in appellate decisions.

D. All non-disciplinary case decisions are recommendations to the Dean of Students or designated representative, and to organizational leadership, members, and students.

E. Defendant's Rights

1. Unless the defendant waives the right, the defendant in any hearing shall receive written and oral notification at least 24 hours prior to the beginning of their hearing in order to adequately prepare a defense.

2. The defendant shall have access to due process.

F. Any student may request to have a case heard directly by the dean of students or designated representative, the request being granted or denied by the Dean of Students and the Student Senate Hearing Board Chief Justice.
